Somfy Systems, Inc. (“Somfy”) respects the privacy of its customers and product users and is committed to maintaining the privacy and confidentiality of the information collected from its customers during the registration and continuing use of the Somfy TaHomA® controller, the TaHomA® software, and this website (the “Services”). The purpose of this Privacy Policy is to explain how Somfy and its resellers, suppliers, licensors or other affiliates (collectively, the “Contributors”) collect, retain and use personal information that may be collected by Somfy or its Contributors during the installation of your controller by an authorized Somfy reseller, during your interaction with the software, when you visit Somfy’s somfytahoma.com website (the “Site”), or when you call Somfy or any of its Contributors to receive sales or technical support. Please read this Privacy Policy to learn about how Somfy manages your personal information, including what information is gathered, why it is gathered, to whom Somfy discloses any personal information, and how your personal information is safeguarded by Somfy.

Why Somfy Collects Personal Information

Somfy strives to provide superior service to its customers. Collecting certain personal information helps Somfy achieve this goal by providing you with more convenient access to the Site and the Services and by ensuring that Somfy meets its internal quality standards.

What Information is Collect by Somfy or its Contributors and When

Upon registering your Somfy TaHomA® controller, you were asked to provide personal information, such as your name, address, phone number, e-mail address and desired password. Somfy or its Contributors may have also collect other information at the time of installation, such as the serial number of your Somfy controller, the date of purchase and any information relating to a support or service issue. No payment information collected by your Somfy authorized reseller is retained or stored by your reseller.

Other information collected during the use of the Services may include last log-in date, certain information collected from your controller device, including log files, device information and network information, as well as that information further set forth below under Site Visit Tracking Technologies.

Somfy and its Contributors may collect this information from you in person during initial purchase and installation of your controller hardware, via conversations or messages exchanged over phone or internet, and through automated systems that log your use of the Services.

Site Visit Tracking Technologies

As is standard practice on many corporate websites, the Site may use “cookies” and other technologies to help Somfy understand which parts of the Site are the most popular and the preferences of Somfy users. Somfy may also use cookies and other technologies to study traffic patterns on the Site, to improve its functionality and usability as well as to improve the effectiveness of Somfy’s communications with its customers. Somfy may also use cookies to customize your experience and provide greater convenience to you during your interactions with the Site.

A cookie is a unique alphanumeric identifier that websites use to help identify the number of unique visitors to a website, whether or not those visitors are repeat visitors, and the source of the visits. Cookies cannot be executed as code or used to deliver a virus and thus pose no threat to you. Servers and sites other than the one placing the cookie on your hard drive cannot read the cookie, and no personal information can be gathered by other servers from the cookie. If you prefer not to enable cookies or to disable them, you may do so through your web browser’s security settings.  Please note that certain features of the Site may not be available once cookies have been disabled.

Like most websites, the Site gathers certain information automatically and stores it in log files. This information includes internet protocol (“IP”) addresses, browser type, operating system, internet service provider (“ISP”), referring/exit pages, date/time stamp of access, and clickstream data.  When you visit the Site, the servers automatically log your IP address, the time and duration of your visit, and the time and duration spent on the pages of the Site which you view. If you arrive at the Site by clicking a paid advertisement or a link in an e-mail, then the server will capture information that tracks your visit from that link. If you arrive at the Site by clicking on a non-paid source, such as a search engine result or link on another website, the server may capture information that tracks your visit from that source, to the extent available. Somfy uses this information to analyze trends, to administer the Site, to track users’ movements around the Site and to gather demographic information about Somfy users as a whole. Somfy will not use the information collected to market directly to you without your consent.

When Somfy Discloses Your Information

Somfy does not sell or rent your personal information to marketers. To help Somfy provide superior service to its customers, your personal information may be shared with legal entities related to Somfy who will safeguard it in accordance with this Privacy Policy. Somfy may make certain personal information about you available to Contributors that Somfy has a strategic relationship with or that perform work for Somfy to provide products and services to you on Somfy’s behalf, including the reseller that installed your equipment. These Contributors may help Somfy process information, fulfill customer orders, deliver products to you, manage and enhance your experience, provide customer service, or conduct customer research or satisfaction surveys. These Contributors are also obligated to protect your personal information in accordance with this Privacy Policy. Without such information being made available, it would be difficult for you to purchase Somfy products, have such products delivered and installed, receive customer service, provide Somfy with feedback to improve it products and services, or access the Services and other services and content on the Site.

At times Somfy may be required by law or litigation to disclose your personal information. Somfy may also disclose information about you if it determines that for national security, law enforcement, or other issues of public importance, disclosure is necessary.

Somfy may release the information it collects to third parties, where the information is provided to enable such third party to provide services to Somfy, provided that the third party has agreed to use at least the same level of privacy protections described in this Privacy Policy, and is permitted to use the information only for the purpose of providing services to Somfy.

How Somfy Protects Your Personal Information

Somfy and its Contributors take administrative, technical, and physical measures to safeguard your personal information against loss, theft, and misuse, as well as unauthorized access, disclosure, alteration, and destruction.

The Site, including the TaHomA® software, uses MD5 encryption when collecting and storing your password. This protects your password from unauthorized access. You can also help Somfy by taking precautions to protect your personal data when you are on the Internet. Be sure to select a password that includes a combination of upper and lowercase letters and numbers which is more difficult to guess

Integrity of Your Personal Information

Somfy has safeguards in place to keep your personal information accurate, complete, and up to date for the purposes for which it is used. You always have the right to access and correct the personal information you have provided. You can help Somfy ensure that your contact information and preferences are accurate, complete, and up to date contacting your Somfy authorized reseller when you move or otherwise change your contact information.

Somfy uses various security measures to protect the information that it collects, as appropriate to the type of information, including encryption, firewalls, and access controls. We store information you provide to us on a computer system located in a controlled facility with a limited access. Somfy databases are accessible only by Somfy, Contributors or other third parties on a need to know basis and who have entered into and are bound by a confidentiality and non-disclosure agreement with Somfy.

Somfy may provide links to third-party websites for your convenience and information. The privacy practices of those sites may differ from Somfy’s practices and are not controlled by Somfy nor covered by this Privacy Policy. Somfy does not make any representations about third-party websites. Somfy encourages you to review the privacy policy of any third-party sitebefore submitting any personal data.

Somfy’s Commitment to Your Privacy

To make sure your personal information is secure; Somfy communicates this Privacy Policy to its employees and Contributors and strictly enforces privacy safeguards within the company.  In addition, Somfy supports industry initiatives to preserve privacy rights on the Internet and in all aspects of electronic commerce. And Somfy does not knowingly solicit personal information from children under the age of 13 or send them requests for personal information.

Somfy abides by the safe harbor framework (the "Safe Harbor Principles") established by the U.S. Department of Commerce regarding the collection, use, and retention of personal information collected from the European Union.

Internal Compliance

Somfy utilizes the self-assessment approach to ensure its compliance with its Privacy Policy. Somfy regularly verifies that this Privacy Policy is accurate, comprehensive, prominently displayed, completely implemented and in conformity with the Safe Harbor Principles and conducts its self-assessment on an annual basis to ensure that all relevant privacy practices are being followed. Appropriate employee training is in place and internal procedures for periodically conducting objective reviews of compliance are in place.  A statement verifying this self-assessment is signed by a corporate officer or other authorized representative at least once a year.
